Terms of Use for The Project Factory website

The Project Factory is a platform that allows members of the public to provide financial support to school projects across Quebec and Ontario. Before using the site, read the Terms of Use for details on how to use the site responsibly and securely.

Some terms apply at all times, while others apply in specific cases only (like when you create an account or make a contribution). Be sure to read the whole document carefully.

When you create an account

Make sure your account is protected

Keeping your account secure is your responsibility. No one can do it for you! Make sure you:
  • Choose a strong password that would be hard to figure out
  • Don't share your password with anyone
  • Don't let anyone else use your account

Your account may be suspended if you violate the Terms of Use

You can only use your account to create or support projects. You must comply with the Terms of Use at all times. If deemed necessary, we may suspend or delete your account.

You can delete your account

If you'd like to delete your account, write to our customer service team at hello@theprojectfactory.ca.However, you can't delete an account if you're part of a team with an ongoing fundraising project.

When you create a project

Your project must be aligned with our values

We welcome a wide range of initiatives! However, all projects must be legal and aligned with The Project Factory's values. These requirements apply to all aspects of a project, including its purpose and the perks offered.

Here are a few examples of what's not allowed:
  • Fraudulent activities
  • Promoting a religion or political party
  • Posting illegal, misleading or inappropriate content
  • Offering cannabis products or illegal goods
  • Promoting violence, discrimination or the sex industry

Perks are optional products or services that you choose and agree to provide to your supporters as a thank-you for their donations.

To organize a draw or contest in Quebec, you must comply with the requirements of the Régie des alcools, des courses et des jeux (RACJ). The food manufacturing and distribution rules in effect in your province apply

Only post content you have the rights for

You can use photos, videos or other content to showcase your project or the perks you're offering. Feel free to get creative!

However, make sure you're authorized to use the content you post. For example, if you want to add a song to a video you made, you need permission to use that song.

We may delete your content if we suspect you aren't authorized to use it.

We will only accept your project if you provide all the required information about it. First, someone from your school must approve the project. Next, The Project Factory will check to see if all the required information was provided and if the project complies with the applicable rules. If necessary, a member of our customer service team may contact the main project representative. We decide whether or not a project can be posted on our site.

You must make a reasonable effort to carry out your project

If we accept your project, your team is required to carry it out and deliver the perks within the estimated time frame. You can set a maximum number of perks per person.

What to do if you encounter problems:
  • If you can't deliver on the scheduled date, let your supporters know and give them a new date
  • If you're unable to provide a perk, we recommend issuing a refund equivalent to the value of the perk

Projects can't be taken down once they've been posted

You can make minor updates such as reworking the project description or adding new photos. However, you can't remove the project or make extensive changes. Once you've received your first contribution, you can't change the price of your perks.

When you contribute to a project

Your contribution is an agreement between you and the school

Thanks for your support! Your contribution to a project is, in whole or in part, a donation to the school so that it can move forward with the initiative. You're responsible for paying the donation amount. In return, the school is required to provide you with the perks you selected.

The school will do its best to estimate the date your items will be delivered, but delays are possible. If there's a problem, contact the school.

You can't request a refund unless explicitly stated in the fundraiser FAQ.

We use a secure external payment platform

Contributions are processed through Global Payments' secure payment platform. Global Payments charges a transaction fee for the use of its platform (2.9% is deducted from the amount you pay). The remainder is remitted directly to the school. We don't have access to the money or your banking information, under any circumstances.

When you register your school

What to do before launching a project

Register the school

You must complete all the required fields when registering your school. This includes appointing an approver from your school who will be responsible for assessing and approving all of the school's projects.

Create a Global Payments account

Either the school or your school service center must have a Global Payments account. You'll receive the contributions through this account. Global Payments collects the contributions via its secure payment platform.

Global Payments charges a transaction fee for the use of its platform. 2.9% will be deducted from the contributions. The remainder will be remitted to the school. Your project team can choose whether they'd like the funds to be transferred once a day or at the end of the campaign.

You're responsible for carrying out the projects at your school

The Project Factory's role is to provide a platform for showcasing projects and collecting contributions. Contributions are agreements between the school and the project supporters.

That means the school is responsible for carrying out its project and fulfilling its commitments to the supporters. You must provide project teams with the support they need to complete the projects. You must also make sure the projects and perks comply with The Project Factory's rules set out in the section called "Your project must be aligned with our values."

When using The Project Factory's website

You must be respectful of the website and its users

Anyone who uses the website must uphold its security and integrity. No hacking allowed! For example:
  • Do not hinder the website's functionality
  • Do not by-pass security measures
Anyone who uses the website must also respect the other website users. For example:
  • Do not collect information about site users
  • Do not contact site users for purposes unrelated to a project
  • Do not pretend to be someone else

You must obtain authorization to reproduce the website's content

We worked hard to create The Project Factory.

We own the website and its content (texts, images, logo, etc.). Some images may belong to others who have authorized us to use them. If you want to reproduce a portion of the website, write to us to request permission.

Project teams are responsible for the content they post on their project pages. You can share a page to promote a project. However, if you want to use the content of the page for other purposes, you must first obtain permission from the project team.

You understand the risks associated with using the website

We take all necessary measures to protect the website and its users. However, as with any other website, an event beyond our control may occur. By choosing to use the website, you accept this possibility.

We are not responsible for the content of other websites. Always be careful when clicking a link to another website. If a link leads to an inappropriate page, please let us know. You may share links to our website, but only where it is legal and appropriate to do so.

Finally, we don’t accept any responsibility for issues related to a project, and you waive your right to sue us. For example:
  • A project doesn't raise as much money as expected
  • You contribute to a project but don't receive the promised perk

We collect personal information while you browse The Project Factory website. What does that mean? Read our Privacy Policy to find out what information we collect and why. It's just a 5-minute read.

We can change these terms

We may modify the Terms of Use if necessary. We'll notify you if we make any major changes. By continuing to use the website, you accept the changes.

The laws of Quebec and Canada apply

The laws of Quebec and Canada apply to these Terms of Use. In the event of a dispute between you and The Project Factory, you agree to settle the dispute only before a court in the judicial district of Quebec.
